Land price indicates the economic values of the land, which is the basic factor to exploit the land resources for development. Fluctuations in land price directly affect the State benefits, land users, and related parties. With the commodity attributes of the land, the land price is considered as the commodity price in the market; simultaneously, the land is the special material for production, which leads to its effects on the prices of other products and services. Thus, land price is a target for exploitation of the land economic values, execution the land administration of the State, especially the land finance field. However, land price is established from the market and always fluctuated. This leads to the requirement of authorized subjects to determine the land price at a specific time point, which is the basis to execute different land administrative contents. The State with its role in land administration and exploitation is the most suitable entity to determine the land price. However, the land determination from the State also exposed some problems: (i) the land price is established from the market; thus, does the right to determine the land price abide by the objective regulations? (ii) What are the requirements that need to be guaranteed to assure the land-price determination right of the State detaching from the administration will in land administration, do not cause any harmful influences on related parties and utmost promote the economic effectiveness of the land? These issues will need to be clarified in the focus of this study. The land price determination right is the harmonized combination of the administrative entities and the economic nature of the land price via the legal aspect. The State right in land price determination has to guarantee the balance in socioeconomic development, contribute to the realization targets of the sustainable development launched by the United Nations. The results showed that the key factor contributing to the success and effectiveness of land-price determination right is the balance of interests. This study applies the specialty of administrative theory to establish the specific requirements as the platform to assure the effectiveness of the State’s land price determination. These requirements were validated through the evaluation of the reality of land-price determination in Vietnam, where the State illustrates an important role and strong influences in land price determination. From these discussions, the conclusions and suggestions were made to consummate the legal aspect of the land price determination right.
