Prenuptial agreement is a form of marriage property established in marriage and family laws in many countries around the world. The recognition of the marital agreement property helps to better ensure the equal rights of husband and wife because they are free to agree on the assets they created before entering marriage. Recognizing the necessity of this property regime, the Law on Marriage and Family of Vietnam 2014 allows couples to choose to apply the statutory property regime or the agreed property regime. This article will focus on analyzing the origin, meaning and content of the property regime as agreed upon in Vietnamese law in combination with comparison with the model in some European countries.
