The 4th scientific and technological revolution creates a premise for the development of a knowledge economy where capital for optimal use and exploitation of resources is an intangible asset - intellectual property rights. It is necessary to recognize the importance of this type of property as soon as possible the importantce of this type of property, in which the important issue is the protection of intellectual property rights, which is a concern of all countries, including Vietnam. In that context, building and aiming to perfect the legal framework on protection of intellectual property rights is very necessary and of great significance in the current period. The content of the article will clarify the following issues: (i) problems arising from the legal regulations related to the mechanism of protection of intellectual property rights; (ii) propose some recommendations to improve the legal provisions of Vietnam.
